Terms of sale

These Terms and Conditions of Sale apply in full as of 07/07/2026.

Any order placed with OLIVIER GUILLE SA constitutes unreserved acceptance of these Terms and Conditions of Sale.

They are drafted in French in their original version, which is the only version that is legally binding and takes precedence over any translated version in a foreign language.

No special conditions may prevail over these Terms and Conditions without the formal, written acceptance of OLIVIER GUILLE SA.

Accordingly, any conflicting conditions set out by the Customer will be unenforceable against OLIVIER GUILLE SA, unless expressly accepted.

Should any provision of these Terms and Conditions be declared void by a court or any other administrative body or authority, such a decision will in no way affect the validity of the remaining provisions.

The fact that OLIVIER GUILLE SA does not, at any given time, exercise a right granted under these Terms and Conditions, or does not require performance of any provision of the agreement arising from them, may not be interpreted as an amendment to the contract, nor as an express or tacit waiver of the right to exercise that right in the future, or to require strict performance of the commitments made herein.

1. Scope of application

These Terms and Conditions of Sale apply to all sales of products intended for consumer customers who are the final users of OLIVIER GUILLE SA's products, concluded via the website http://www.collegien-shop.com, and exclude professional customers.

2. Applicable law

Any question relating to these Terms and Conditions of Sale, and to the sales they govern, that is not addressed herein shall be governed by French law, excluding the 1980 Vienna Convention on Contracts for the International Sale of Goods.

3. Identity of the seller

The sales offers featured on the website http://www.collegien-shop.com are issued by OLIVIER GUILLE SA, a French joint-stock company (SA) with capital of €591,567, whose registered office is located at 4, rue de la Bonneterie, BRIATEXTE (81390), France, registered with the Castres Trade and Companies Register under number 775 711 708.

4. Products

OLIVIER GUILLE SA manufactures and sells products as precisely described on the website http://www.collegien-shop.com: original slipper-socks, ribbed plain or patterned knee-high and ankle socks, and ribbed plain tights, available in a range of 25 original, on-trend colors.

5. Orders

Customers can view the products offered for sale by OLIVIER GUILLE SA on the website http://www.collegien-shop.com.

Should the Customer wish to place an order, they must first register on the website to become a customer.

To do so, they will complete an online form, following the instructions provided, entering the information required for identification purposes, including their surname, first name, postal address, and delivery address.

The user will need to provide a username and password, which will be personal and confidential.

Once the Customer has chosen to purchase products marketed by OLIVIER GUILLE SA and presented on the website http://www.collegien-shop.com, they will finalize their order — having reviewed the on-screen summary — by clicking to confirm their commitment, and their knowledge and acceptance of these Terms and Conditions of Sale.

6. Prices

Our product prices are shown in Euros and are inclusive of all taxes.

Any charge for processing and/or shipping costs will be clearly stated to the Customer before the order is placed.

OLIVIER GUILLE SA reserves the right to change its prices at any time. However, products will only be invoiced based on the rates in effect at the time each order is placed, as shown on the website http://www.collegien-shop.com.

7. Product availability

Product offers and prices proposed by OLIVIER GUILLE SA are valid for as long as they remain accessible on the website http://www.collegien-shop.com, and only within the limits of available stock.

Should any ordered product(s) be unavailable, the Customer will be informed by email as soon as the order is received.

The Customer may then choose to request a refund of the amount paid, or delivery of an equivalent or similar product in exchange for the price already paid.

Any difference between the price originally paid by the Customer and the price of the replacement product will either be refunded to the Customer, if in their favor, or will require the Customer to pay the price difference.

8. Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, where the sales contract has been concluded by the Customer via OLIVIER GUILLE SA's website http://www.collegien-shop.com, the Customer has a withdrawal period of fourteen (14) clear days from receipt of the ordered products.

Where the fourteen-day period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended to the next working day.

Aside from the Customer's right to withdraw within the period and under the conditions set out above, the contract is firm and final as soon as it is accepted by the Customer.

Notwithstanding the above provisions, products whose packaging has been opened, that have been used by the Customer, or that have been damaged, cannot be returned by the Customer and will not be accepted.

In all cases, return shipping costs in the event of withdrawal will be borne by the Customer.

9. Delivery

Products will be delivered to the address expressly provided by the Customer at the time the contract is concluded, subject to confirmation by OLIVIER GUILLE SA.

Delivery costs are communicated to you before the order is accepted on the website http://www.collegien-shop.com.

Risk relating to the products transfers to the Customer upon receipt.

Except in cases of force majeure, products will be delivered within thirty (30) days of the Customer placing the order.

Any change to the order during the performance of the contract, if accepted by OLIVIER GUILLE SA, will necessarily extend the delivery times.

10. Payment

The price is payable in Euros at the registered office of OLIVIER GUILLE SA, at the time the order is placed.

For the purposes of this article, payment means the effective transfer of funds to OLIVIER GUILLE SA.

11. Retention of title

Ownership of the ordered products will only transfer to the Customer upon full payment of the price.

In the event of non-payment, OLIVIER GUILLE SA may demand, at the Customer's sole expense and risk, the return of unpaid products by registered letter with acknowledgment of receipt, without this affecting any of OLIVIER GUILLE SA's rights.

12. Intellectual property

OLIVIER GUILLE SA expressly reserves ownership and exclusive enjoyment of all intellectual and industrial property rights belonging to it, which the Customer may become aware of or make use of in connection with any sales contract.

The Customer shall not use any intellectual or industrial property rights belonging to OLIVIER GUILLE SA without its prior written authorization.

The Customer shall not file any industrial property title relating to inventions, designs, trademarks, plans, processes, software, prototypes, or elements of prototypes, or any other item made available by OLIVIER GUILLE SA.

13. Legal warranty

The Customer benefits, in all cases, from the legal warranties of conformity of the goods with the contract and against hidden defects, in accordance with the provisions of the Consumer Code and the Civil Code reproduced below.

However, where repairing the product under the legal warranty would cost OLIVIER GUILLE SA more than the price of the delivered product, OLIVIER GUILLE SA may decide to replace the product with an identical one.

Article L217-3 of the Consumer Code

The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation, where installation was the seller's responsibility under the contract or was carried out under the seller's responsibility.

Article L217-5 of the Consumer Code

To conform to the contract, the goods must:

1° Be fit for the purpose ordinarily expected of similar goods and, where applicable:

match the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

have the qualities that a buyer may legitimately expect, given the public statements made by the seller, the manufacturer, or their representative, particularly in advertising or labeling;

2° Or have the characteristics defined by mutual agreement between the parties, or be fit for any specific purpose sought by the buyer, brought to the seller's attention and accepted by the seller.

Article L217-12 of the Consumer Code

Any action resulting from a lack of conformity is time-barred two years from delivery of the goods.

Article 1641 of the Civil Code

The seller is liable for hidden defects in the goods sold that render them unfit for their intended use, or that reduce that use to such an extent that the buyer would not have acquired them, or would have paid a lower price, had they been aware of them.

Article 1648, first paragraph, of the Civil Code

Any action resulting from latent defects must be brought by the buyer within two years of discovering the defect.

14. Personal information

Information concerning the Customer, collected in connection with any order for OLIVIER GUILLE SA's products via the website http://www.collegien-shop.com, is necessary for OLIVIER GUILLE SA to process orders.

This information is recorded in OLIVIER GUILLE SA's customer database, and the Customer may exercise their right of access and rectification by contacting OLIVIER GUILLE SA's customer service, in accordance with the French Data Protection Act ("Informatique et Libertés") of January 6, 1978.
